Special counsel Jack Smith turned in his final report to Attorney General Merrick Garland and departed the Department of Justice on Saturday, but whether the public will be able to access the report remains uncertain.

According to a former SDNY Criminal Division Deputy Chief, Attorney General Merrick Garland can resolve his dilemma over the release of special counsel Jack Smith's investigation of Donald Trump's stolen government documents with a simple instruction to his Department of Justice.

It wasn’t immediately clear if Trump would appeal the Smith report case decision to the top court. His spokesperson Steven Cheung said that it’s “time for Joe Biden and [Attorney General] Merrick Garland to do the right thing and put a final stop to the political weaponization of our Justice system.”
